Acceptance of terms
By using this website, contacting Byte Craft Enterprises, requesting a quotation, purchasing a service or continuing a project with us, you agree to these Terms & Conditions. If you do not agree, please do not use our services.
These terms apply unless a separate written agreement, proposal or contract states otherwise for a specific project.
Services covered by these terms
Byte Craft Enterprises may provide services such as:
- website design and development;
- mobile app design and development;
- WordPress development and related support;
- graphics, product visuals and promotional design;
- testing, maintenance, publishing and update work;
- custom electronics, IoT and proof-of-concept projects; and
- digital product support, technical consultation and related services.
The exact service, deliverables and limits of work will normally be defined in the quotation, proposal, project message or written confirmation sent to the client.
Quotations, proposals and scope
Quotations and proposals are based on the information provided by the client at the time of enquiry. They normally describe the intended scope, expected deliverables, estimated timeline and pricing.
A quotation does not automatically include extra features, future upgrades, content writing, premium assets, third-party subscriptions, hosting, app-store fees, domain registration or any other item not clearly stated.
If the project requirements change after approval, the price, timeline and work plan may also change.
Client responsibilities
The client is responsible for providing accurate information, timely feedback, approvals, content, brand assets, access credentials and any other material needed to complete the work.
- ensure submitted content is lawful and appropriate to use;
- review drafts, previews and milestone outputs in reasonable time;
- keep login details secure on the client side;
- confirm final content before publishing or submitting to stores/platforms; and
- inform us promptly if a priority issue or error is found.
Delays caused by missing content, slow approvals or incomplete instructions may extend the delivery schedule.
Timelines and delivery expectations
Any timeline given by Byte Craft Enterprises is an estimate unless a fixed schedule has been specifically agreed in writing.
Delivery time can be affected by scope changes, client response speed, third-party review processes, app-store approvals, hosting issues, technical limitations or force-majeure events beyond reasonable control.
We aim to communicate major timeline changes as early as reasonably possible.
Payments, deposits and outstanding balances
Payment terms may vary by project, but many projects require an advance payment, milestone payment or full payment before final handover, launch or transfer.
- deposits are generally used to reserve work time and begin production;
- milestone payments may be required for larger or phased projects;
- final files, transfers or live publishing may be withheld until payment is complete;
- late payments may delay progress or support response; and
- third-party platform charges are not included unless clearly stated.
Unless otherwise stated in writing, payments already made for work completed or time already allocated are non-refundable.
Changes, revisions and additional work
Reasonable revisions may be included where stated in the quotation or package. Revisions apply to improving the agreed work, not changing the project into a different scope.
Additional screens, new modules, major redesigns, new integrations, unexpected technical changes or repeated content changes may be treated as extra work and priced separately.
Intellectual property and usage rights
Unless otherwise agreed in writing, the client receives the right to use the final approved deliverables for the intended business or project purpose after full payment has been made.
Byte Craft Enterprises retains ownership of pre-existing tools, reusable systems, development methods, internal libraries, templates, know-how and general processes used to produce the work.
The client must ensure that any logos, images, videos, text or materials supplied to us do not infringe the rights of others.
Confidentiality and client project privacy
We respect the confidentiality of client information and project material. Byte Craft Enterprises does not intentionally share private client project information, confidential documents, internal business information or restricted materials with unrelated third parties unless:
- the client gives permission;
- sharing is necessary to deliver the service through a trusted provider or platform;
- the information is already public; or
- we are required to do so by law or a legitimate legal process.
We also do not disclose one client’s private project details to another client. Privacy and discretion are important parts of how we operate.
Third-party services and platforms
Some projects depend on third-party providers such as hosting companies, domain registrars, payment gateways, cloud services, app stores, analytics tools, APIs, plugins, messaging services or software platforms.
We are not responsible for downtime, policy changes, rejection decisions, price changes, account suspensions, service failures or data loss caused by external third-party providers.
Where helpful, we may assist with setup or submission, but the client remains responsible for ongoing third-party account ownership, fees and compliance unless another arrangement is clearly agreed.
Testing, approval and publishing
We aim to test work appropriately before delivery or launch. However, no software, website, app or technical system can be guaranteed to be completely free from all defects in all devices, browsers, operating systems or environments.
When clients approve a design, version or release, that approval confirms that the project is acceptable at that stage based on what has been presented.
Publishing support may include assistance with app-store submission, website launch or deployment, but final approval may still depend on platform rules, account access and third-party review.
Support, maintenance and updates
Unless specifically included in a package or separate agreement, ongoing maintenance, monitoring, future edits, version upgrades, compatibility fixes, security updates, content changes and technical support are not automatically included after project completion.
Support may be offered through:
- a maintenance plan;
- a support package;
- a one-time paid service request; or
- a special written arrangement for a product or project.
Warranty disclaimer and limitation of liability
Services are provided in good faith and with reasonable professional care. However, except where required by law, Byte Craft Enterprises does not provide unlimited warranties of uninterrupted service, platform acceptance, specific business outcomes, ranking performance, revenue growth or permanent compatibility with all future updates from third parties.
To the maximum extent allowed by law, Byte Craft Enterprises will not be liable for indirect, incidental, special or consequential loss including lost profits, lost opportunities, lost data, downtime, reputational loss or business interruption arising from the use of our services or deliverables.
Suspension, cancellation or termination
We may pause, suspend or terminate a project or service if there is non-payment, abusive behaviour, unlawful use, repeated failure to provide required information, misuse of deliverables or other serious breach of these terms.
A client may also request cancellation. In that case, work already completed, time already allocated and third-party costs already incurred may still be payable.
Changes to these terms and contact details
Byte Craft Enterprises may update these Terms & Conditions from time to time to reflect service changes, legal requirements, platform changes or business improvements.
